Since inception, The Westchester Community Foundation has operated as an affiliate of The New York Community Trust.

As part of our centennial celebrations, we are creating a single, unified organization to more powerfully advocate for our region with one voice.

We will still maintain our physical offices in Westchester with the same dedicated staff who will continue to honor and build upon our relationships with local nonprofits and communities.

This website (“Site”) is operated by the New York Community Trust (“The Trust,” “we,” or “our”).  The Trust is in fact two organizations (The New York Community Trust and Community Funds, Inc.) about which you can learn more on our Site.  The Trust is committed to protecting your privacy.  This Privacy Statement (“Statement”), which is part of our Terms of Use, governs our collection, use, storage, sharing and protection of your information.  By using our Site, you agree to this Statement.  We may modify this Statement at any time by posting a revised version on our Site or, if we determine appropriate, by sending you email or other notice.  Please review this Statement from time to time because your continued use of our Site after a modified Statement has been posted indicates your consent to the Statement.

You may use our Site for different purposes, such as visiting our donor portal (“Donor Portal”) to access and manage your fund, visiting our grantee portal (“Grantee Portal”) to apply for and manage grants, or accessing our grant newsletters, professional tax and estate planning notes, annual reports, and other information to learn about charitable giving generally and supporting The Trust in particular.

Collection and Use of Information

The Trust collects personally-identifiable information about you (“Personal Information”) only when you voluntarily provide it to us.  Personal Information may include your name, physical address(es), email address(es), telephone number(s), gender, marital status, hobbies and interests.  For example, we may collect your Personal Information when you sign up for our newsletters, when you create a fund, register on the Donor Portal, or when you register your nonprofit organization on the Grantee Portal and apply for a grant.  You may register on behalf of an organization only if you have authority from the organization to bind the organization to our Terms of Use and Privacy Statement.

We will use your Personal Information for the purposes for which you provide it, such as administering your fund or grants, facilitating transactions, or responding to inquiries.  We may also send you communications about programs, events, and opportunities that we think may be of interest to you.  If you ever wish to stop receiving communications, you may opt out by following the “unsubscribe” instructions in email communications or by sending us an email to maillist@nyct-cfi.org, calling us at (212) 686-0010, or mailing to New York Community Trust, Attention: Mail List, 909 Third Avenue, New York, NY 10022.  If you are a donor or grantee you may not be able to opt out of certain administrative and similar communications concerning your fund or your grants.

We may combine your Personal Information collected through our Site with information collected from publicly available sources to perform research and analysis concerning donors and potential donors and their interests.

We do not sell, share or trade your Personal Information, including donors’ names, with other entities and we do not send mailings to our donors on behalf of other organizations.

This policy applies to all Personal Information, whether we collect it online or offline.

The Trust will keep your Personal Information as long as required to deliver our services, to evaluate current or prospective donors, or as may be required by law or regulation.

Use of Cookies and Similar Technologies

Like many websites, our Site uses the Google Analytics tool.  Google Analytics uses “cookies,” which are small text files placed on your computer, to collect anonymous, non-personal data, including IP address, browser type, domain names, time and date of visit, referring web site, landing page, and web pages viewed.  This non-personal data is used for such purposes as identifying web pages visited most often to improve our Site and providing you a better experience on our Site.  You may prevent Google Analytics from recognizing you when you visit our Site by disabling cookies on your browser.  Please review Google Analytics’ terms of use and privacy policy to learn more about how Google Analytics may collect and use information. [add link: https://www.google.com/analytics/terms/us.html]  If we ever combine non-personal data with personally-identifiable information, the combined information will be treated as personally-identifiable information.  If you wish to listen to our podcasts, SoundCloud may use cookies so that it recognizes you and your preferences.  Again, you may block or disable cookies if you choose.

From time to time, the Trust may use cookies and similar technologies for the purpose of making our Site easier to use (such as remembering you if you registered for an event).

Our Site is not currently configured to respond to “do not track” signals or similar mechanisms.

Sharing with Third Parties

We may share your Personal Information with companies that help us operate our Site and provide services (“Service Providers”), including web hosting, email, and fulfillment services.  In addition, our Service Providers may collect your Personal Information when you participate in certain activities such as when you make an online donation, sign an online grant agreement, recommend a grant through our donor portal, submit a grant proposal on behalf of an organization, or listen to podcasts.  Our Service Providers may share selected information they collect with us (but will not share your payment card information).  Our Service Providers are required to maintain the confidentiality of your Personal Information and to use it only for the purposes of providing the requested services.

We reserve the right, without notice, to disclose and use Personal Information and non-personal data in special circumstances, including to enforce this Privacy Statement or other Terms, to protect The Trust’s or another party’s property or rights, to protect the safety of any one, to protect against fraud, and for other reasons we determine in good faith are necessary, appropriate or required by law, legal process, law enforcement, or regulatory authorities.  If we ever merge with or otherwise consolidate with another organization, your Personal Information may be shared or transferred as part of our assets.

Review and Update Your Information

We will use reasonable efforts to let you review your Personal Information and, upon your instructions, to correct inaccuracies in your Personal Information in our records.  If you are a current donor and wish to review and update your Personal Information, you can do so in your profile page if you registered on the Donor Portal or by contacting us at em@nyct-cfi.org.

Links to Third-Party Sites and Social Media Sites

Our Site may contain links to other third-party sites including our Service Providers (“Third-Party Site”).  We encourage you to review the privacy statements and terms of use of Third-Party Sites so you will understand how they collect, use, and share personally-identifiable information.

We may share content from social media sites on our Site.  You are solely responsible for any such content that you further distribute, which may be subject to the privacy statements and terms of use of the social media sites.

Security

We use firewalls, authentication procedures, and other reasonable steps to keep your Personal Information in a secure manner and to protect it from unauthorized access.  Our Service Provider encrypts payment card information using secure socket layer technology.  Of course, no transmission over the Internet can be guaranteed to be 100% secure, so you provide your Personal Information at your own risk.

Location of Servers and Transfer of Information

Our servers are located in the United States.  If you are located outside of the United States, be aware that the information you provide to us will be transferred to the United States.  By using our Site or providing your Personal Information to us, you consent to this transfer and to the collection, storage, processing and use of your Personal Information in the United States.  If you are located in the United States, our Service Providers (or other entities with which we share your information) may not be located in your geographic area in the United States.  By providing your Personal Information on our Site, you consent to the transfer of your Personal Information to these locations and entities.

Children Under Age 13

We do not knowingly collect any personally-identifiable information about anyone under age 13.  If you are a parent or legal guardian who believes we have collected personally-identifiable information about your child under age 13, please send us notice to maillist@nyct-cfi.org so that we may delete the information.
